Please be aware that purchases can only be cancelled until they are dispatched. In the event that an unauthorised purchase is dispatched prior to your notifying us of the unauthorised nature of the purchase, Smart Boutique Ltd accepts no liability or responsibility and you should make contact with the Carrier detailed in the Purchase Information.
4.5 We reserve the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at our discretion.
5.1 We can only accept orders for items that are in stock. In terms of availability if some items are out of stock but you would like to order you need to click at “Contact me When Available” and thus when we have this item in stock we will send you an e-mail about that. If for any reason the items you ordered are no longer available we will at our discretion either:- offer you an alternative item of equivalent quality and price (where this is possible); or- cancel the item from your order and where payment has already been deducted from your account give you a full refund in respect of that item.
5.2 Once you have selected an item from our range by clicking on the button “Add to Bag„ the details of product will be added to the “Shopping Bag”. Before placing an order you can review and amend your order at any time by clicking on the “Shopping Bag”.
5.3 When You place an order for Goods, this constitutes an offer to purchase those Goods which Smart Boutique Ltd may or may not accept.
5.4 When you order via our Website your Credit / Debit Card/ Paypal account has to be authorized, payment received in full and stock checked before we send you via e-mail receipt confirming your order. Please keep this receipt for your records.
5.5 We will send you another e-mail when we dispatch your goods which shall constitute our acceptance of your order, at which point a binding contract of sale will be concluded between you and us. We will file a copy of any orders that are accepted by us. If your order contained a number of items and the email mentions only some of them, those items which have yet to be dispatched to you do not form part of that contract.
5.6 You are responsible for ensuring the email address and other contact details you provide to us are correct. We will not be responsible if you do not receive the Despatch email or other confirmation from us where the details you have supplied are incorrect or in the event of communication system failures outside our control.
5.7 If purchases are cancelled for any reason prior to dispatch you will be refunded any monies paid in relation to those purchases.
5.8 If you terminate your Account any non-dispatched purchases will be cancelled and you will be refunded any monies paid in relation to those purchases.
6.1 Whilst every effort has been made to ensure that all graphical representations, sizes, colours, and descriptions of Goods available from Smart Boutique Ltd correspond to the actual Goods, Smart Boutique Ltd is not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different Goods altogether.
6.2 Where appropriate, you may be required to select the required [size] [model] [colour] [number] [other features] of the Goods that you are purchasing. We may from time to time vary the sizes and specifications of items displayed on our Website without prior notice. We cannot guarantee that a particular colour, size or specification of an item will be available. We will contact you if the item you have ordered is no longer available.
6.3 All pricing information on the Website is correct at the time of going online. Smart Boutique Ltd reserves the right to change prices and alter or remove any special offers from time to time and as necessary.

6.5 Delivery and packaging is charged extra. Details of our delivery charges can be found in the Delivery section of these Terms and Conditions.
6.6 Items are invoiced in GBP sterling at the price prevailing at the time you place your order. Please note that we can only accept payment in GBP sterling.
7.1 You can by debit or credit card or via Your Paypal account, if You have one. We regret that we cannot accept cheques or cash. The full payment price will be debited from your card/account upon or shortly before dispatch of the goods to you.
7.2 You confirm that the credit or debit card that is being used is yours. All credit or debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept reason for the refusal.
7.3 Non-delivery by any third party shall not give You any right to delay payment to Smart Boutique Ltd or to make any claim whatsoever against Smart Boutique Ltd.
8.1 All orders will be despatched via courier. We deliver to 100% UK postcodes (including Northern Ireland, IOM, and IOW), and to the Channel Islands. We do not deliver to BFPO addresses and PO box addresses, and we don’t offer international delivery.
8.2 Deliveries are usually made Monday to Friday (sometimes Saturday). Precise day and timing of a delivery cannot be specified. The delivery address you choose may be different to the billing one and should be specified at the time of online checkout.
8.3 Our standard delivery costs just £3.99 and our express delivery is £5.99 per order including packaging regardless of the parcel weight and the number of items per order. If we need to send your order in separate parcels, you will still be charged delivery cost just once.
8.4 All parcels will be delivered direct to your home. If there is no one available at the delivery address to accept the order, the courier will put a card through your letterbox with their contact details so that re-delivery can be arranged at a time convenient for you. Couriers will try to deliver your order three times and if all attempts fail, the parcel will be returned.
8.5 We will send you an email with a parcel tracking number once your order has been despatched and instructions how to track your parcel online.
8.6 We are unable to change the delivery address once you have placed an order. However, if there is no one to accept the parcel, a card will be left for you with instructions to re-arrange delivery.
8.7 If you think an item is missing from your order or that you have received a wrong or faulty item, please contact us via using the contact details in section 19 straight away and we will resolve any issues as soon as possible – we will send replacements or offer you a refund.
8.8 As soon as the goods are delivered to you, they become your responsibility.
9.1 Our returns and exchanges service is free (also applies for sale items) and you have 14 days from receipt to decide if you want to return or exchange an item.
9.2 Items must be returned unused, in saleable condition without marks or scents, and in their original packaging. Any returned items will be inspected on receipt. We will only be able to provide a refund or exchange if the item has been returned in a suitable condition.
9.3 Returns for Goods are handled via Royal Mail. Items must be wrapped adequately to prevent damage during transit. Please complete the forms enclosed with your item(s) stating your reasons for return, the item number you wish to return and whether you want a refund or exchange. Enclose the completed form in the parcel and affix the return label to the front of your parcel. Always request a proof of posting certificate and keep this until you have received your refund from us. Regrettably, we cannot be held responsible for returned items which do not reach us or items which have been returned in error.
9.4 We will send you an email once your returned item has been received and processed. If you do not receive an email from us within 10 days of posting your parcel, please contact us with details of the item returned, date posted and the reference number from your posting certificate.
9.5 Refunds will be issued to the credit/debit card or Paypal account you used for your purchase within 10 working days of us receiving the returned item(s).We will refund the value of the item(s) you purchased but not the delivery charge except in cases where the whole order is cancelled.
10.1 In addition to our 14 days return policy, you have a statutory right to cancel your order and receive a full refund (including delivery charges if the whole of your order is cancelled) provided you notify us in writing that you are exercising this right of cancellation no later than seven working days beginning the day after you received your goods. 11.1 Risk in the items will pass at the time the items are delivered. Ownership of items delivered will only pass when we receive payment in full of all sums due in respect of the items (including packing and delivery costs). If we do not receive payment in full we may, without prior notice, claim from you any items that have been delivered.
12.1 To the maximum extent permitted by law, Smart Boutique Ltd accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. 12.5 By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site. We are also not liable for any damages associated with use of this site however caused. Smart Boutique Ltd’s total liability for any claim howsoever arising shall not exceed the price of the goods supplied by Smart Boutique Ltd to the customer, together with any postage costs incurred. 13.2 Smart Boutique Ltd accepts no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
